KenVanLiew.com, NYREIAcademy.com, REIAcademy.com are the internet sites of Ken Van Liew. (“KVL”) and TVL Administrative/Design Systems (?TVL?). KVL and TVL may include other internet sites affiliated with TVL Administrative/Design Systems and its affiliates (collectively referred to herein as “we,” “us,” or “our”).
There are three types of products sold through the above businesses as noted above. In the case of a 3rd party product being fulfilled by the 3rd party, the terms and conditions of the return policy noted herein apply. These terms and conditions must be accepted prior to processing your order. By accepting these terms and conditions you have forfeited your right to refund outside the terms and conditions outlined below for each specific product as governed by the Refund Policy.
Monthly University/Continuity Training with monthly reoccurring billing.
These types of product have a free trial period which constitutes the return policy time period. If within the designated time period of 7 days (return policy time period) the buyer is entitled to cancel the product which prevents the initial billing to occur. If the buyer fails to cancel the order during the trial period you will be billed the first payment for the product received in the amount noted in the sales letter. On the 8th day the billing period begins whereby the buyer is scheduled for a monthly reoccurring billing. If at any time during the month (billing period) after the initial transaction they are entitled to cancel their order for any future billing. This does not constitute a refund of the previous billing. You have the time period prior to the next monthly reoccurring charge to cancel for any reason. This product provides confidential information, material knowledge and intellectual propriety valued over $3,000 and therefore our terms and conditions of the refund policy for this type of product is strict in accordance to the language herein.
Home Study Courses
The home study course will be delivered to the buyer within 14-21 days of the purchase date due to preparation and fulfillment requirement by 3rd party fulfillment company. Upon receipt of the home study course the refund policy begins as of the receive date at the address given by the buyer to purchase the product. Upon receipt of the course there is a strict 30 day return policy. During the 30 day period after receipt of product the purchaser has the right return the product after thourough review. In the event the buyer elects to return the product, the product must be returned in good condition whereby seller can reuse the product for future sales. Should the product be returned not in the original condition and it is determined unusable due to tampering by the buyer a charge of $250 will be deducted from the original purchase price.
Live Seminar Training Events
This is a live event purchased by the buyer with accepted terms and conditions. Non attendance does not constitute a refund. In the event the purchaser cannot attend for emergency reasons they will be NOT entitled to a refund. They will be able to attend a future event for up to one year from the scheduled event. The locations and future dates will be determined and may not be in the same location as the original scheduled event. The refund policy for live event is as follows with no exceptions. The buyer can attend the live training and by 5:00 PM on the 1st day of training if the buyer is not satisfied with the training conducted on day 1 they must notify formally in writing and submit to on-site administrator their request to receive refund in the full amount. In the case of the refund they can keep all the free gifts valued at over $3,000 dollars for their time spent attending the course. The buyer MUST return the seminar workbook before they can obtain refund.
All the above terms and conditions constitute the return policy for the companies referenced and based on this policy the companies have no further liability related to their relationship of the buyer other than the cost of the product.
How we gather information from users
How we collect and store information depends on the page you are visiting, the activities in which you elect to participate and the services provided. For example, you may be asked to provide information when you register for access to certain portions of our site or request certain features, such as newsletters or when you make a purchase. Be aware, however, that third parties, including our partners, advertisers, affiliates and other content providers accessible through our site, may have their own privacy and data collection policies and practices. For example, during your visit to our site you may link to, or view as part of a frame on a KenVanLiew.com page, certain content that is actually created or hosted by a third party. Also, through KenVanLiew.com you may be introduced to, or be able to access, information, Web sites, features, contests or sweepstakes offered by other parties. KenVanLiew.com is not responsible for the actions or policies of such third parties. This policy and the use of this Site are governed by Maryland law. If a dispute arises under this Policy we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Newark, New Jersey. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.
If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Baltimore, Maryland, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
